1. Introduction: Who is COSMESI SICILIANA?
   
   1.1 COSMESI SICILIANA is a limited liability company with registered office inVia Colonnello Romey, 15 – 91100 Trapani – Italia.1.2 The website www.cosmesisiciliana.eu where only original products are sold.1.3 These general terms and conditions of sale (hereinafter only “General Terms and Conditions”) govern the sale of products marketed by www.cosmesisiciliana.eu. All product purchase contracts concluded through the websitewww.cosmesisiciliana.eu and according to the procedures indicated therein, between COSMESI SICILIANA (seller) and the customer, will be governed by these General Terms and Conditions.
2. Acceptance of the general terms and conditions of sale
   2.1 The contract stipulated between COSMESI SICILIANA and the Customer must be considered concluded with the acceptance, even if only partial, of the order by COSMESI SICILIANA which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general and payment conditions transcribed below.

2.2 If the Customer is a final consumer (i.e. a natural person who purchases the goods for purposes not related to their professional activity), once the online purchase procedure has been completed, they will print or save an electronic copy and, in any case, keep these general terms and conditions of sale, in compliance with the provisions of the laws on remote selling in force from time to time.

2.3 Any right of the Customer to compensation for damages or indemnification, as well as any contractual or non-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order is excluded.

3. Purchase method
   
   3.1 The Customer can only purchase the products present in the electronic catalogue ofwww.cosmesisiciliana.eu3.2 Correct receipt of the order is confirmed by COSMESI SICILIANA through an automatic e-mail reply, sent to the e-mail address supplied by the Customer during the order procedure. This confirmation message will contain the order execution date and an “Order Number” to be used in any further communication with COSMESI SICILIANA.
The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections or changes. The customer can also check the status of their order by accessing the web area dedicated to them. To access the dedicated area, it will be necessary to log in from the website and then choose the item “Order Information”.3.3 In case of non-acceptance of the order, COSMESI SICILIANA undertakes to promptly notify the Customer by email.
   3.4 All prices on the website are to be intended as prices to the public. COSMESI SICILIANA reserves the right to change the prices at any time, without notice. The price change will not entitle customers to claim compensation. 3.5 On certain products, COSMESI SICILIANA reserves the right to accept orders by reducing their quantities, subject to communication and acceptance by the Customer.
4. Terms of payment
   
   4.1 Advance Bank Transfer: In case of payment by bank transfer in advance or by other accepted payment methods, the customer’s order is held for 7 days. If the customer does not send a copy of the bank transfer within 7 days, the order may be automatically cancelled.
The purpose of the bank transfer must include the Order Number that is issued in the order confirmation email and the SURNAME of the sender.4.2 Bank transfers from Italy: Iban code: IT88O0200801400000105657170 account held by COSMESI SICILIANA.4.3 In cases of the purchase of goods using the a credit card payment method, the credit card will be debited at the same time as the online transaction is concluded.4.4 At no time during the purchase procedure is COSMESI SICILIANA able to know the information relating to the buyer’s credit card as it is transmitted via a secure connection directly to the website of the bank that manages the transaction. No computer archive of COSMESI SICILIANA contains or keeps such data. In no case can COSMESI SICILIANA therefore be held liable for any fraudulent and improper use of credit cards by third parties following payment for the products purchased on www.cosmesisiciliana.eu 4.5 PayPal: in cases of purchase of goods using the PayPal payment method, at the same time the online transaction is concluded, PayPal will immediately charge the amount relating to the purchase made at no additional cost.
5. Delivery Methods
   
   5.1 Delivery by courier: Delivery by courier takes place in the name and on behalf of the end customer always from the COSMESI SICILIANAVia Colonnello Romey, 15 – 91100 Trapani – Italia. For every order placed onwww.cosmesisiciliana.eu the costs for collection to be paid by the Customer are indicated in the section “Collection/Delivery Methods” and are explicitly highlighted at the time the order is placed. Payment for the goods by the Customer will take place using the method chosen when ordering. No additional expenses or commission are due to COSMESI SICILIANA. The delivery times of the ordered goods are purely indicative and may vary due to force majeure or to weather conditions (heavy snow), traffic and road conditions in general. Standard delivery will take place every day, except holidays, from Monday to Friday. No responsibility can be attributed to COSMESI SICILIANA in case of delay in order fulfillment.5.2 Upon collection of the goods, the Customer is required to check:
- that the number of packages delivered corresponds to what is indicated.
- that the packaging is intact, not damaged or wet or, in any case, altered, including the sealing materials (branded adhesive tape).
Any damage to the packaging and/or to the product or a discrepancy in the number of packages or indications must be immediately reported, stating WRITTEN CONTROL RESERVATION (SPECIFYING THE REASON FOR THE RESERVATION, e.g. “packaging with holes”, “crushed packaging”, wet packaging, etc.) on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer will not be able to make any objection regarding the external characteristics of what has been delivered and if the wording “accepted with reservation” has not been affixed it will not be possible to activate any refund procedures.
6. Privacy
   
   6.1 The personal data requested when placing the order are collected by www.cosmesisiciliana.eu and processed on computer media in order to satisfy the obligations arising from the contract concluded with the Customer and will not in any case and for any reason be transferred to third parties.6.2 COSMESI SICILIANA guarantees its customers compliance with the legislation on the processing of personal data.6.3 The data controller is COSMESI SICILIANAVia Colonnello Romey, 15-91100 Trapani – Italia in the person who from time to time has legal representation, unless a data officer is appointed. The customer may at any time revoke the consent to the processing of personal data with written communication to be sent to the registered office of COSMESI SICILIANA 6.4 Marketing communications will only be sent with the explicit consent of the Customer, issued together with the authorisation for processing and sending, in the online registration form.
7. Complaints – Right of Withdrawal

7.1 In compliance with the provisions of Italian Legislative Decree 6 September 2005 no. 206 (and subsequent amendments and additions), the Consumer Customer, if not satisfied with the products or the content of the services purchased from the Seller, may return the products themselves or renounce the right to provide the services and obtain a refund of the price already paid in place of advance payment.

Implementation mode: For this purpose the Customer must contact the Seller within 14 working days following the delivery of the products or within 14 working days following the purchase of the services, by sending a communication via registered letter with return receipt to COSMESI SICILIANA Via Colonnello Romey, 15-91100 Trapani – Italia, containing all the necessary and useful information for correct processing of the return and refund procedure. This communication must necessarily contain everything indicated below:

1. the express intention of the Customer to wish to withdraw in whole or in part from the purchase contract;
2. the number and copy of the document proving the purchase of the order in respect of which the right of withdrawal is to be exercised;
3. the description and codes of the Products with respect to which the right of withdrawal is exercised.

The customer will be contacted shortly thereafter for the return authorisation

The goods must be sent to COSMESI SICILIANA Via Colonnello Romey, 15-91100 Trapani – Italia, with a traceable shipment and the shipping costs incurred will be charged to the customer. The refund (excluding shipping costs incurred for sending of the item) will be made by PayPal or bank transfer within 14 working days of receiving the goods.

The right of withdrawal lapses in the case of:

– The absence of the essential condition of integrity of the item (packaging and/or its contents)
– The use, even partial, of the item and of any consumable materials
– The absence of external packaging, official labels and/or of original internal packaging
– The absence of integral elements of the product (accessories, manuals, parts…)
– Damage to the product for reasons other than its transportation

In the cases indicated above, we will return the purchased item to the sender, charging the cost of shipping.
Customers who purchase with a VAT number and those who purchase customised goods cannot exercise the right of withdrawal.

8. Jurisdiction and applicable law
   
   8.1 The sales contract between the customer and COSMESI SICILIANA is concluded in Italy and regulated by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this remote sales contract, the territorial jurisdiction is exclusively that of the Court of Ravenna – Italy.
9. Changes to the Terms and Conditions
   
   9.1 The terms and conditions contained in this document may be modified by COSMESI SICILIANA without prior notice and will be valid from the date of publication on the website www.cosmesisiciliana.eu
